O R D E R

This writ petition has been filed challenging the order passed by the 1st respondent in Na.Ka.No. 5161/2024/Aa4, dated 30.04.2025 and consequently direct the respondents 1 and 2 to cancel the joint patta issued in the name of the respondents no. 3 to 10 in respect of the landed property in Survey No. 200/2A situated at Seelapadi Village, Dindigul West Taluk, Dindigul District.

2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents 1 and 2. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself. Since no adverse orders are going to be passed against the private respondents, notice is dispensed with.

3. The facts of the case are that the impugned order came to be passed by issuing patta to the respondents 3 to 10 along with the petitioner in the subject property, which is in S.No.200/2A situated at Seelapadi Village, Dindigul West Taluk, Dindigul District. 3/6

The learned counsel for the petitioner submits that a civil suit, filed by the respondents 3 to 10 against the petitioner seeking declaration of title over the subject property, was in-fact dismissed. Thereafter, an appeal was preferred with a delay of 500 days. The delay has not been condoned and needless to say, there is no stay in the appeal proceedings.

5. The learned Government Advocate would submit that in view of the orders passed in the civil suit, the 1st respondent Revenue Divisional Officer would undertake the exercise and accordingly issue patta after hearing all the parties concerned.

Recording the said submission, the 1st respondent shall undertake the said exercise and accordingly issue patta, after hearing all the parties concerned and in view of the judgment passed in the civil suit, within a period of twelve weeks from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. There shall be no order as to costs.
