This writ petition has been filed seeking issuance of a writ of mandamus, directing the fourth respondent to issue a house site patta in the petitioner's name as per circular on the order dated 17.10.2019 passed by the third respondent, based on the petitioner's representation dated 12.10.2017 within the time limit.
2. Heard the learned counsel for the parties. 2/6
3. The petitioner submitted a representation dated 12.10.2017 to the respondents seeking house site patta as per circular dated 17.10.2019 passed by the third respondent. However, no action has been taken on the said representation. Hence, the present writ petition has been filed.
4. Learned Government Advocate, appearing on behalf of the respondents 1 to 5 and 7, submits that the Director of Survey and Settlement, Chennai, is the competent authority to take appropriate action in this regard. However, the petitioner has not impleaded him as a party to this writ petition.
5. In view of the above submissions, this Court suo motu impleads the Director of Survey and Settlement, Chennai, as the seventh respondent and without expressing any opinion on the merits of the matter, this writ petition stands disposed of with a direction to the seventh respondent/ Director of Survey and Settlement to consider the petitioner's representation dated 12.10.2017 on merits and in accordance with law and to pass appropriate orders within a period of sixteen weeks from the date of receipt of a copy of this order. 3/6
6. The representation shall be considered and disposed of after conducting an inquiry. The seventh respondent is further directed to afford a reasonable opportunity to the petitioner and to all other persons who may be affected by such decision during the course of the inquiry. There shall be no order as to costs.
