PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the second and third respondents to not to harass the petitioner and his family members under the guise of enquiry. O R D E R

This petition has been filed seeking a direction to the second and third respondents to not to harass the petitioner and his family members under the guise of enquiry.

2.The learned counsel for the petitioner submitted that there is a business transaction dispute between the petitioner and the fourth respondent. Upon which the fourth respondent lodged a complaint to the third respondent implicating the wife of the petitioner also. According to him, his wife is no way involved in the business transaction. However, summons were also issued to her also.

Crl.O.P.(MD)No14513 of 2021 of the complaint given by the fourth respondent herein, wherein, some allegations have been against the wife of the petitioner. She also accompanied with her husband.

4.When there is a specific allegation with regard to the role played by the wife of the petitioner in transaction, it is the duty of the petitioner's wife to appear before the Enquiry Officer and to co-operate with him to complete the enquiry. If any trouble arises out of the enquiry, they shall work out their remedy through proper proceedings. Hence, question of harassment at the initial stage may not arise.

5.With the above liberty, this criminal original petition is disposed of.
