Criminal Original Petition filed under Section 483 of Bharatiya Nagark Suraksha Sanhita, 2023 (439 of Cr.P.C.,) to relax the condition imposed in Crl.MP.No.4081 of 2024 in Crl.MP.No.3886 of 2024 on the file of the Principal Sessions Judge, Thanjavur, dated 06.06.2024 in connection with the Crime No.121 of 2024 on the file of the respondent police.

O R D E R

This petition has been filed to relax the condition imposed in Crl.MP.No.4081 of 2024 in Crl.MP.No.3886 of 2024 on the file of the Principal Sessions Judge, 1/4

Thanjavur, dated 06.06.2024 in connection with the Crime No.121 of 2024 on the file of the respondent police.

2.The petitioner was enlarged on bail in Crl.MP.No.3886 of 2024 dated 30.05.2024 on the file of the learned Additional District Judge, Fast Track Court, Kumbakonam/Vacation Sessions Judge, Thanjavur, on certain conditions. One of the condition is that, the petitioner has to appear and sign before the respondent daily at 10.30 a.m for a period of 15 days from the date of his release without fail. Thereafter, due to his ill health, he filed a modification petition in Crl.MP.No.4081 of 2024 before the learned Principal Sessions Judge, Thanjavur and the same was allowed 06.06.2024 by modifying the condition that the petitioner has to appear and sign before the respondent monthly once on the 1st day of every English Calender month for three months without fail. But, now the petitioner is going to undergo surgery. Hence, he is not in a position to comply with the condition. Hence, he prays to relax the condition.

3.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent. 4.Considering the submission made by the learned counsel for the petitioner, the aforesaid condition is modified to the effect that, " the petitioner shall appear and sign before the respondent police as and when required for interrogation. 2/4
