PRAYER :-For Bail in Crime No.262 of 2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner is facing charges under Sections 392, 397 and 506(2) IPC and Section 25(1)(a) of Arms Act, 1959 in Crime No.262 of 2022, on the file of the respondent police.

2.The case of the prosecution is that the defacto complainant lodged a complaint stating that on 14.07.2022 at about 07.00 am., when he was cleaning the bar, two persons came there and tried to rob money. When the neighbours gathered there, the accused persons fled away from that place. On the basis of the aforesaid complaint, the case has been registered and two persons have been arrayed as accused and one of the accused has been granted bail by this Court in Crl.O.P.(MD) No.13841 of 2022, vide order dated 01.08.2022. Now, seeking bail, this petition has been filed on the ground that the petitioner is in judicial custody for more than 40 days. 3.The learned Government Advocate (Crl.side) for the respondent would submit that the petitioner is having previous cases at his credit.

CRL OP(MD). No.14176 of 2022 4.Reading of the list shows that most of the cases are either theft or robbery. Considering the antecedents of the petitioner, if he is released on bail, there is no guarantee that he will not commit similar offences in future.
