ORDER

This writ petition has been filed seeking for a direction to forbear the 2nd and 3rd respondents from interfering in civil dispute in respect of the petitioner's land and thatched house in Natham S.No.399/19, admeasuring 0.42.67 Hec, Naduvakurichi Village, Barkitmanagaram, Tirunelveli District, based on his representation dated 26.04.2026.

The learned counsel appearing for the petitioner submitted that the fourth respondent is holding a post equivalent to that of an Additional Secretary in the Government and, by allegedly misusing his official position and influence, is continuously interfering with the petitioner's peaceful possession 2/6

and enjoyment of the subject property. It was further submitted that the second respondent is acting in collusion with the fourth respondent and they are continuously threatening and harassing the petitioner. Aggrieved by the said acts and apprehending further interference, the petitioner has filed the present writ petition seeking appropriate relief.

The learned Government Advocate appearing for the respondent police submitted that, on receipt of a complaint from the fourth respondent, an enquiry was duly conducted in connection with the complaint lodged by the petitioner. Upon assessing the possibility of a law and order issue arising between the parties, the matter was referred to the Revenue Divisional Officer and assigned L.I.R. No.96 of 2026. It was further submitted that the proceedings are presently pending before the Revenue Divisional Officer for appropriate action.

4. Heard the learned counsel on either sides and carefully perused the materials placed before this Court. Considering the nature of the order proposed to be passed in this petition, notice to the 4th respondent is dispensed with.

5. From the arguments made by either parties, it is seen that the 4th respondent is an influential government official, who is able to manipulate the civil dispute by giving a criminal colour. In view of the same, the Revenue Divisional Officer, Tirunelveli, is suo motu impleaded as the 5th respondent, for whom, Ms. M.R.Priyanka Jothi, Government Advocate takes notice.

The fifth respondent is directed to conclude the enquiry initiated on the request made by the 3rd respondent police as expeditiously as possible, after giving opportunity of hearing to the petitioner and the 4th respondent, preferably, within a period of four weeks from the date of receipt of a copy of this order. It is made clear that, insofar as the civil dispute between the parties is concerned, the respondent police shall not interfere except to the extent necessary for maintaining law and order.

7. With the above direction, this writ petition stands disposed of. Consequently, connected miscellaneous petition is closed. 11.06.2026 NCC : Yes / No Index : Yes / No sm 4/6
