PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the 1st respondent police not to harass the petitioner under the guise of an enquiry, entering into the Civil dispute.

ORDER

This petition is filed seeking direction to the 1st respondent not to harass the petitioner under the guise of an enquiry, on the basis of the complaint given by the 2nd respondent herein. 2.The learned counsel appearing for the petitioner would submit that the petitioner and the 2nd respondent herein are the brothers. A civil dispute is pending between them. Based upon the complaint given by the 2nd respondent herein, the 1st respondent is harassing the petitioner.

3.The learned Government Advocate (Crl.side) appearing for the 1st respondent would submit that so far no complaint has been received against this petitioner by the 1st respondent. 4.When no complaint has been received and no enquiry is pending, the question of harassment is premature and does not arise at all. So, if any trouble arises in future, the petitioner may workout his remedy before the appropriate Court through appropriate proceedings.
