PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, 2023, to transfer the investigation regard to the Cr.No.28 of 2026, pending on the file of the 3rd respondent to some other competent investigation agency and pass such other or further orders.

ORDER

The present petition has been filed by the Defacto-complainant in Crime No.28 of 2026 on the file of the 3rd respondent police, seeking to transfer the investigation on the ground that the 3rd respondent has not initiated any action as against the accused person.

2. The learned Government Advocate appearing for the third respondent submitted that summons were issued on 17.05.2026 for the appearance of the accused. However, the accused has sought time and has not appeared before the police so far.

3. In view of the above facts, this Court does not find any legal ground to transfer the investigation. However, a direction is issued to the third respondent police to complete the investigation within a period of one month from the date of receipt of a copy of this order.

4. With the above directions, this Criminal Original Petition stands disposed of.
