Prayer : Criminal Original Petition filed under Section 528 of BNSS, to transfer the investigation in Crime No.16 of 2025, on the file of the Inspector of Police, District Crime Branch, Theni/the second respondent herein to any other higher officer under the direct supervision of the first respondent herein.

The petitioner is a dealer of Royal Enfield Motors, running the business in the name of ''Krishna Motor & Sales'' at Sukkuvadanpatti, Theni District. The petitioner with a grievance that the staff of the petitioner have misappropriated a sum of Rs.72,14,948/-, has lodged a complaint before respondent police and the same was registered in Crime No.16 of 2025, however, the accused has not been arrested so far and the misappropriated amount has not yet been recovered by the respondent police. Therefore, the petitioner has filed this application, seeking transfer of investigation from the file of respondent police to some other investigating agency.
2.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor, who takes notice for the respondents submits that the case was registered only on 19.05.2025 and they are conducting investigation and as a part of investigation, they have made a request to the accused bankers to freeze their bank accounts.

3.Since the respondent police has taken some action to freeze the bank account of the accused persons and considering the fact that the investigation is in initial stage, this court is not inclined to interfere with the investigation at this stage. However, there shall be a direction to the respondent police to conduct the investigation in a fair manner. The first respondent/ Superintendent of Police shall monitor the investigation in Crime No.16 of 2025.
4.With the above directions, this Criminal Original Petition is disposed of.
