Prayer in CRL.A(MD).No.947 of 2023:- This Criminal Appeal filed under Section 14(A) (2) of the Schedule Castes and Tribes Prevention of Atrocities Act, 2015, praying to call for the records pertaining to the impugned order passed in Crl.M.P.No.985 of 2023, dated 03.10.2023 on the file of the Special Court for Trial of Cases under SC/ST (POA) Act, Thoothukudi and enlarge the appellant on bail set aside and allowing this Criminal Appeal.
ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. S.M.Mohan Gandhi, Advocate for the Petitioner and of Mr. B.Thanga Aravindh, Government Advocate(Criminal Side) for the respondent No.1 and 2, this Court made the following order:
This petition has been filed to relax the condition imposed in Crl.M.P.(MD) No.3487 of 2024 in Crl.M.P(MD)No.17740 of 2023 in Crl.A(MD)No.947 of 2023 dated 21.03.2024.
2. The learned counsel for the petitioner Mr.S.M.Mohan Gandhi and learned Government Advocate (Crl. Side) appearing for the respondent police are present before this Court.
3. The learned counsel for the petitioner submitted that the petitioner has been complying with the condition imposed by this court regularly.
4. The learned Government Advocate (Crl.Side) submitted that the petitioner has been complying with the condition regularly and also submitted that the 2/4
investigation is going on.
5. Considering the said submission, the condition imposed as against the petitioner is relaxed and the petitioner is directed to report before the respondent police as and when required for interrogation.
