PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the second respondent police not to harass the petitioner to pay a sum of Rs.2,10,000/- (Two Lakhs Ten Thousand) to the third respondent without cause instead of Nashir Ahamed. For Petitioner : Mr.A.Vadivel For R1 and R2 : Mr.K.Suyambulinga Bharathi Government Advocate (Crl.Side)

ORDER

This petition has been filed seeking direction to the second respondent police not to harass the petitioner.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the official respondents. Considering the nature of the order going to be passed in this petition, notice to the third respondent is dispensed with.

3. According to the petitioner, based on the complaint given by the third respondent before the second respondent against one Selvakumar, who is the brother of the petitioner herein, alleging cheating, the second respondent police is harassing the petitioner. Hence, the present petition has been filed.

4. Today, when the matter was taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the official https://hcservices.ecourts.gov.in/hcservices/ 1/4

Crl.O.P.(MD)No.11697 of 2019 respondents, on instructions, would submit that on the complaint given by the third respondent against one Selvakumar alleging that he has received money promising to get a job in abroad and cheated him, enquiry has been conducted. During enquiry the petitioner has appeared before the respondent police and assured that he will pay the money. Recording the said submission, the complaint has been closed. He further submitted that the second respondent has not harassed the petitioner.

5. In view of the submission made by the learned Government Advocate (Crl.Side), that the compliant lodged by the petitioner has been enquired into and closed, no further order is required in this petition. Accordingly, this Criminal Original Petition is closed.
