ORDER

The petitioner claims that she belongs to suppressed community. She is having a piece of land. The Councillor of the panchayat in a high handed manner has laid road without acquiring land. The petitioner has raised an objection that it is her patta land. However it has been ignored by him and road has been laid. 2.The learned Additional Public Prosecutor appearing for the respondents submits that they have advised the petitioner to get a survey report with regard to the place, where road is laid. However, the petitioner has not taken any steps to conduct the survey and fix the boundaries. Therefore, they are not in a position to find out whether there is a trespass in the petitioner's land. 3.This Court considered the rival submissions made. 2/5

4.Considering the facts and circumstances of the case, the petitioner shall file an application before the revenue officials concerned for conducting survey on her land along with a copy of this order and necessary documents. The survey shall be conducted in the presence of the petitioner and also in the presence of the police officers. In the event if the road has been laid on the petitioner's land, it amounts to trespass and therefore, case needs to be registered and on such event, the petitioner is at liberty to claim damages before the competent civil court.
