ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 4(1-A), 4(1)(a), 4(1)(i), 24A of Tamil Nadu Prohibition Act, in Crime No.84 of 2023, seeks anticipatory bail. 2.The earlier anticipatory bail petition filed by the petitioner was dismissed by this Court on 06.06.2023. Considering the previous antecedents of the petitioner, the petition filed for anticipatory bail was dismissed as against the petitioner herein, based on the representation given by the respondent. 3.Now, it is confirmed by the learned Government Advocate (Crl.Side) that the petitioner is not having any previous case at his credit.

CRL OP(MD). No.12242 of 2023 any previous case at his credit and this is the second petition for anticipatory bail, this Court is inclined to enlarge the petitioner on anticipatory bail.

5.Accordingly, this Criminal Original Petition is allowed and petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate, Peraiyur, Madurai, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioners shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
