Challenging the staff fixation proceedings for the academic year 2024 - 2025, dated 05.12.2024 and the consequential rejection order dated 27.05.2025 passed by the third respondent, the present writ petition has been filed by the petitioner.
2.The petitioner school is a 100-year-old institution and receives grant-in-aid from the State Government. The grievance of the petitioner School is 2/6
that although by following G.O. (1D) No.217, School Education [S.E.5(1)] Department, dated 20.06.2019, the strength of the teaching staff was fixed at 14 for the academic year 2023 - 2024 for classes 6 to 10, the third respondent issued the impugned proceedings dated 05.12.2024, declaring one post of a teacher as surplus and reducing the sanctioned strength of the teaching staff for Classes 6 to 10 from 10 to 9. In this regard, the petitioner School has also submitted a detailed representation seeking the sanction of an additional post. However, the same was rejected by the third respondent by communication dated 27.05.2025. Challenging the said impugned proceedings, the petitioner has filed the present writ petition.

The learned counsel for the petitioner would submit that although the staff fixation has been rejected for the academic year 2024 - 2025 and that now the strength of the students has increased, this Court may issue a direction to the respondents to consider the petitioner School's staff fixation for the academic year 2025 - 2026, for which the particulars have already been submitted in accordance with G.O. (1D) No.217, dated 20.06.2019. 3/6

In response, the learned Additional Government Pleader appearing on behalf of the respondents submits that since the students strength has been increased and the petitioner School has submitted its proposal for staff strength fixation for the academic year 2025 - 2026 in terms of G.O. (1D) No.217, dated 20.06.2019, the respondents will conduct an enquiry into the said proposal and pass appropriate orders in accordance with law, within the time frame stipulated by this Court.
5. In the light of the aforesaid submission, this Court is of the view that no further orders are required to be passed in the writ petition insofar as the impugned proceedings are concerned. However, the respondents are directed to conduct an enquiry into the petitioner School's proposal for staff strength fixation for the academic year 2025 - 2026 and to pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
