ORDER : The Court made the following order :- The petitioner, who was arrested on 26.06.2021 for the offences punishable under Sections 8(c) read with Sections 20(b)(ii)(C) and 25 of NDPS Act in Crime No.357 of 2021 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that on 26.06.2021, on secret information, the Sub Inspector of Police, Subramaniapuram Police Station along with police party had gone to the place of occurrence for inspection. They had found a Hundai Creeta White Car bearing Registration No.TN 58 BW 0155 with two bags of ganja, weighing 40 Kgs in total. The police party arrested the accused and seized the ganja along with the vehicle. Hence, the complaint. https://hcservices.ecourts.gov.in/hcservices/

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Additional Public Prosecutor appearing for the respondent police opposed this petition on the ground that the contraband has been recovered from the petitioner.

5. Considering the nature of offence and the fact that the contraband has been seized from the petitioner, the quantity of the contraband, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
