ORDER

The petitioner has come up with this writ petition seeking for the issuance of a writ of mandamus, to direct the respondents to disburse destitute widow / old age pension under Indira Gandhi National Old Age Pension Scheme (IGNOAPS) with effect from March 2015 in the light of the sanction order of the second respondent in Ni.Mu/29380/B6/09/DWP 152/09/B6, dated 03.08.2009 to the petitioner.

2.Heard Mr.J.Ashok, learned counsel appearing for the petitioner and Mr.V.Muruganandam, learned Additional Government Pleader appearing for the respondents.

3.According to the petitioner, she is a destitute widow. Considering her claim, the second respondent granted old age pension by an order dated 03.08.2009 and thereafter, she has continuously received the same till February 2015. But the second respondent stopped the pension from 2015 and therefore, she approached the second respondent who in turn orally informed her that she is not eligible to get pension. Hence, the petitioner has submitted a representation dated 31.08.2015 to the second respondent which is still pending. Therefore, the petitioner has filed this writ petition.

4.When the matter came up for hearing, learned Additional Government Pleader appearing for the respondents would submit that even though the oldage pension was granted to the petitioner by an order dated 03.08.2009, after enquiry it was found that the petitioner is not entitled for pension under the above scheme and therefore, by an order dated 27.08.2014, the oldage pension granted to the petitioner has been cancelled by the Revenue Divisional Officer, Palani. However, an opportunity was also given in the impugned order to file an appeal. In the meantime, the petitioner has filed another representation seeking for pension. Based on the fresh enquiry, it was found that the petitioner is eligible to get oldage pension. In the above circumstances, the second respondent passed an order dated 24.11.2016, granting oldage pension at the rate of Rs.1000/- per month to the petitioner.

5.In view of the said submission, nothing survives for further adjudication in this writ petition. Accordingly, the writ petition is disposed of. No costs.
