PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the 1st respondent not to harass the petitioner under the guise of enquiry frequently.

ORDER

This petition is filed seeking a direction to the 1st respondent not to harass the petitioner under the guise of enquiry on the basis of the complaint given by the 3rd respondent herein. 2.When the matter is taken up for hearing, the learned Government Advocate (Crl.side) for the respondents 1 and 2 would submit that based upon the complaint given by this petitioner, enquiry is underway in CSR.No.344 of 2021 and the petitioner did not cooperate for the enquiry.

3.The learned Government Advocate (Crl.side) has also produced a copy of the enquiry report, wherein, it has been stated that the petitioner and the 3rd respondent herein are the neighbors. The allegation is that the 3rd respondent and others are trying to encroach the land of the petitioner. The 3rd respondent appeared before the Enquiry Officer and gave a statement to the effect that there is a dispute with regard to patta proceedings, which is pending before the Revenue Divisional Officer. https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.14296 of 2021 4.Since it is a land dispute between the petitioner and the 3rd respondent herein, let the 2nd respondent may close the complaint by directing the parties to approach the proper proceedings, which is also pending before the Revenue Divisional Officer, which is a patta issue. If any trouble arises in future, the petitioner is at liberty to workout his remedy through proper civil forum. 5.With the aforesaid direction and liberty, this petition is disposed of.
