PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the 3rd respondent police to provide adequate police protection to the petitioner and his family members on the basis of the representation given by the petitioner on 31.07.2021. For Petitioner : Mr.P.Thambidurai For R1 to R3 : Mr.K.Sanjai Gandhi Government Advocate (Crl.Side)

ORDER

This petition is filed seeking direction to the respondents 1 to 3 to give police protection on the basis of the representation dated 31.07.2021.

2.The learned counsel for the petitioner would submit that there is money transaction between the petitioner and the private respondents herein and during the pandemic situation, he is not in a position to repay the borrowed amount. It appears that the private respondents are making trouble and gave a complaint, based upon which, the petitioner made a representation seeking police protection.

3.The learned Government Advocate (Crl.side) for the respondents 1 to 3 would submit that based upon the complaint given by this petitioner, enquiry was undertaken in CP.No.G3/566/31999/CGDP/2021 and during the course of enquiry, the petitioner as well as the counter party, namely, Pandi appeared and they entered into an agreement, by which, the petitioner undertook to repay the amount within 2 months. Crl.O.P.(MD) No.14324 of 2021 4.It appears that it is a money dispute between the petitioner and the counter party herein. So, the question of granting police protection does not arise, since the petitioner himself has withdrawn the complaint.

5.The undertaking given by the petitioner has been accepted by the counter party. So, the learned counsel for the petitioner may get a copy of the closure report from the office of the learned Government Advocate (Crl.side).

6.Recording the submission made by the learned Government Advocate (Crl.side) and placing on record the agreement reached between the parties and the undertaking given by this petitioner, nothing survives for further consideration or direction. 7.This petition is disposed of as infructuous, accordingly.
