Respondents Prayer: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the first and second respondent to consider the examination fee remitted by the petitioner on 20.10.2016 and permit the petitioner to write the examinations in the remaining four subjects of the 7th semester viz., (1) Mechatronics (subject code-ME 6702), (2) Process Planning and Cost Estimation (subject code-ME 6005) (3) Power Plant Engineering (subject code-ME 6701) and (4) Maintenance Engineering (subject code-ME 6012) to be held on 26.11.2016, 28.11.2016, 06.12.2016 and 08.12.2016 respectively and evaluate the answer sheets of all the five subjects (including the answer sheet of the subject code No.6757- "Total Quality Management" in which examination was held on 02.11.2016) and publish the results of all the subjects along with other students. This writ petition has been filed by the petitioner praying to write the 6th and 7th Semester Examination.
2.According to the petitioner, he is studying 7th Semester in the second respondent-college and he has sufficient attendance to write the examination and he has also paid the necessary fees for the same. Since the petitioner has arrears in the 6th Semester, he https://hcservices.ecourts.gov.in/hcservices/
has paid the fees for 6th Semester and also for 7th Semester. But inadvertently, the petitioner's name was not included in the list submitted by the second respondent College to the first respondent University. In the above circumstances, the first respondent did not issue Hall Ticket, hence, the writ petition. 3.Earlier, this Court, by an order dated 23.11.2016, directed the first respondent University to permit the petitioner to write the examinations. Pursuant to the said order, out of 5 examinations, the petitioner written three examinations. 4.Today, when the matter is taken up hearing, the learned Senior Counsel appearing for the second respondent College submitted that the petitioner paid the fees and he has also having sufficient attendance to write the examination, only due to the some mistake, the petitioner's name was not included in the list submitted by the second respondent to the first respondent seeking Hall Ticket. Regarding the same, immediately, the second respondent college sent a representation along with fees to the first respondent University.
5.The learned counsel appearing for the first respondent also submitted that only due to the mistake of the second respondent, the first respondent is not in a position to issue Hall Ticket and they have received the fees and verified the same. 6.Admittedly, the second respondent College already sent the particulars along with fees and the first respondent University has also verified the same. Therefore, the first respondent University is directed to released the result of the petitioner for examination written by the petitioner.
7.With the above direction, this writ petition is closed. No costs. Consequently, connected miscellaneous petition is also closed.
