ORDER

This Criminal Original Petition has been filed seeking a direction to direct the learned Fast Track Judicial Magistrate No.I, Nagercoil, to dispose of the case in STC No.243 of 2020 within a stipulated time that may be fixed by this Court.

2.The learned counsel for the petitioner would submit that the 1/4

petitioner has filed case against the respondent for issuance of cheque under Section 138 of the Negotiable Instrument Act. The same has been taken on file in STC No. 243 of 2020 and it is pending from 2020 without much progress. The petitioner was examined in chief and exhbits Ex.P.1 to Ex.P.6 have been marked, but he was not cross examined by the respondent. The respondent is not co-operating for trial, therefore he has filed the present petition.

Considering the fact that this case was instituted for the offence under Section 138 of the Negotiable Instrument Act and also the fact that the petitioner was examined in chief, this Court directs the learned Fast Track Judicial Magistrate No.I,Nagercoil to dispose of the case in STC No.243 of 2020 as expeditiously as possible preferably within a period of three months from the date of receipt of a copy of this order. 4.With the above direction, this Criminal Original Petition is disposed of.
