For Respondent : Mr.M.Karunanithi Government Advocate (Crl.Side) PETITION FOR AMENDMENT Under Sec.528 of BNSS PRAYER :- To amend the offence the offences are wrongly mentioned as 294(6), 115 (2), 351(3), 326 of BNS and Section 4 of TNPWH Act instead of 296(b), 115(2), 351(3) of BNS and Section 4 of TNPWH Act in Crl.O.P.(MD).No.9443 of 2025 dated 12.06.2025.

ORDER : The Court made the following order :- This petition has been filed to amend the offence the offences are wrongly mentioned as 294(6), 115(2), 351(3), 326 of BNS and Section 4 of TNPWH Act instead of 296(b), 115(2), 351(3) of BNS and Section 4 of TNPWH Act in Crl.O.P.(MD). No.9443 of 2025 dated 12.06.2025.

2. The learned Counsel appearing for the petitioner would submit that there is a typographical error occurred in the Sections the said Criminal Original Petition, it is inadvertently stated the offences under Sections 294(6), 115(2), 351(3), 326 of BNS and Section 4 of TNPWH Act , instead of under Sections 296(b), 115(2), 351(3) of BNS and Section 4 of TNPWH Act. He further submits that the petitioner prays further time to comply the condition imposed in Crl.O.P.(MD).No.9443 of 2025 dated 12.06.2025.

3. Considering the submissions made by the learned counsel for the Petitioner 2/4

and being satisfied with the reasons stated above, this Court is inclined to allow this Criminal Miscellaneous Petition.

4. Accordingly, this Criminal Miscellaneous Petition is allowed. Registry is directed to add the following Sections In para.1 of the order made in Crl.O.P.(MD). No.9443 of 2025 dated 12.06.2025 ''under Sections 296(b), 115(2), 351(3) of BNS and Section 4 of TNPWH Act'' and issue fresh order copy, also carry out necessary amendment in the petition in Crl..O.P.(MD).No.9443 of 2025. This court also granted further period of ten days to comply the condition imposed in the order made in Crl.O.P.(MD).No.9443 of 2025 dated 12.06.2025, from the date of receipt of a copy of this order.
