ORDER
The Writ Petition is filed challenging the impugned refusal check slip.
2. When the petitioner presented a sale deed for registration, the same was refused to be registered on the ground that the value mentioned in the sale deed is lesser than the guideline value and therefore, the document was refused.
3. I have also heard the learned Government Standing Counsel appearing on behalf of the respondent.
4. If the Sub Registrar is of the opinion that there is an undervaluation of the property, the course open is to register the document and refer the same under Section 47-A(1) of the Indian Stamp Act, 1899, in the manner known to law and the document itself cannot be refused to be registered. 2/4
5. In view thereof, this Writ Petition is allowed on the following terms:
(i) The impugned refusal check slip, dated 01.06.2026 shall stand set aside;
(ii) Within three weeks from the date of receipt of a web copy of this order, the petitioner is entitled to represent the document;
(iii) Upon which, the same shall be duly registered and if the Sub Registrar is of the opinion that there is undervaluation, he may, by following the due procedure, make a reference under Section 47-A(1) of the Indian Stamp Act, 1899.
(iv) No costs.
