PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.400 of 2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner, who is arrayed as A3, apprehending arrest at the hands of the respondent police for the offences punishable under Section 381 of IPC, on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner and others have stolen the mosquito net worth about Rs.50 lakhs from the defacto complainant's company and sold the same to one Sarvesh at Salem. Hence, the present complaint.
3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. The petitioner is not having any bad antecedent and hence, he prayed for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.13951 of 2020 4.The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petitioner along with other accused persons have stolen the mosquito net worth about Rs.50 lakhs. He further submitted that earlier this Court has dismissed the anticipatory bail application of the co-accused, by an order dated 26.11.2020, in Crl.O.P.(MD).Nos. 13426 of 2020. 5.Taking into consideration the submissions made by the learned Government Advocate(Criminal Side) this Court is not inclined to grant anticipatory bail to the petitioner.
6.Hence the petition stands dismissed.
