PRAYER: Writ Petitions filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus calling for the records in pursuant to the impugned order dated 28.06.2024 in No. 10/10-11A-1 of the 1st respondent and quash the same consequently direct the respondents to pay the terminal benefits along with the 1/5

statutory interest for the delay in payment together with all other attendant benefits to the petitioner.

ORDER

The petitioner, who was working in the respondent society as an Assistant, was placed under suspension on the date of his superannuation in view of the disciplinary proceeding pending as against him and he was retained in the service. Challenging the same, the petitioner has filed this writ petition.

2.When this writ petition is taken up for hearing, the learned counsel for the first respondent submits that the petitioner did not offer his explanation and therefore, the disciplinary proceedings were delayed. Now he has offered his explanation and they would proceed further with the disciplinary proceedings.

3.The learned counsel for the petitioner submits that the petitioner has offered his explanation on 02.01.2025.

4.This Court has considered the rival submissions made. 5.Now the petitioner has offered his explanation and therefore, there may not be any impediment for the respondents to proceed with the disciplinary proceedings. Since the disciplinary proceedings are pending from the year 2021, the respondents are directed to conclude the disciplinary proceedings and pass final orders within a period of three months from the date of receipt of a copy of this order. The petitioner is expected to co-operate for the enquiry.
