Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.ABUL KALAM AZAD.C, Advocate for the petitioner and of MR.M.VAIKKAM KARUNANITHI, Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- This petition is filed to modify the condition imposed upon the petitioner to the effect that the petitioners shall appear before the respondent police as and when required instead of appear before the respondent police daily at 10.30 a.m, in Crl.OP(MD)N0.10860 of 2022 dated 22.06.2022.
2.By the order, dated 22.06.2022, the petitioners were directed to appear before the respondent police daily at 10.30 a.m, until further orders.
3.The learned counsel for the petitioners submitted that the petitioners have complied the condition for the past 30 days without fail and no previous case is pending against them. Since the first petitioner is having severe heart problem and regularly taking treatment at Coimbatore and the second petitioner's wife was affected with Cancer disease and residing at Salem, they are not in a position to comply the condition regularly. https://www.mhc.tn.gov.in/judis 1/2
CRL MP(MD) No.9365 of 2022 4.Considering the submission made by the learned counsel for the petitioners, the condition passed by this Court, in Crl.OP(MD) No.10860 of 2022 dated 22.06.2022, is modified to the effect that the petitioners shall appear before the respondent police as and when required for interrogation.
