PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., directing the second respondent to seek the expert opinion of fingerprints expert to examine mortgage deed dated 08.02.2016 and the police complaint of the third respondent dated 25.02.2020, as prayed for in the petitioner's complaint dated 10.11.2020. For Petitioner : M/s.Chamundi Bose For R1 & R2 : Mr.R.M.Anbunithi Additional Public Prosecutor.

ORDER
This petition has been filed seeking a direction to the second respondent to seek expert opinion of fingerprints available in the mortgage deed dated 08.02.2016 and the police complaint of the third respondent dated 25.02.2020.
2. Today, when the matter is taken up for hearing, Mr.P.M.Vishnuvarthan, the learned counsel proposed to file Vakalat for the third respondent.
3. In the meantime, the learned Additional Public Prosecutor appearing for the respondents 1 & 2, on instructions would submit that the enquiry in CSR No.841 of 2020 was undertaken and the same was closed on 30.11.2020, finding that the issue involved in this complaint is civil in nature. https://hcservices.ecourts.gov.in/hcservices/ 1/2

5.Recording the submission made by the learned Additional Public Prosecutor, (Crl.side) that the petition enquiry was closed and nothing survives for further adjudication, this Criminal Original Petition is disposed of. The petitioner is at liberty to seek his remedy before the appropriate Civil Forum.
