PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the respondents 1 to 3 not to interfere with the civil dispute based on the complaint of the petitioner dated 02.06.2023. For Petitioner : Mr.S.Sathya Chidambaram For R1 to R3 : Mr.B.Thanga Aravindh Government Advocate (Crl.side) O RDER This petition is filed seeking for a direction to the respondent police not to interfere in the civil dispute based on the representation given by the petitioner dated 02.06.2023.

2.It is submitted by the learned counsel for the petitioner that there are disputes between the petitioner and the unofficial respondent Nos.4 to 7 in respect of the temple and its properties, thereby the respondent Nos.4 to 7 with the help of the respondent Nos.2 and 3 police are asking the petitioner to vacate the land belonging to the temple.

3.It is submitted by the learned Government Advocate (Crl.side) that earlier the respondent Nos.4 to 7 have filed a writ petition before this Court vide W.P. (MD) No.14530 of 2021 and the same was disposed of on 17.08.2021 and in the said petition, the present petitioner was impleaded as one of the respondents, wherein a direction was given to survey the property by giving opportunity to all the parties.

4.Based on the direction of this Court in W.P.(MD) No.14530 of 2021, survey was conducted and demarcated the land allegedly belonging to the respondent Nos.4 to 7. The petitioner at the request of the respondent Nos.4 to 7 went to the land, where survey was conducted and at that time, the petitioner has shown certain documents claiming that he is the owner of the property. At that juncture, the police have withdrawn from the land, as the issue between the parties is purely civil in nature.

5.It is further submitted that the police are not involved subsequently in the civil dispute between the petitioner and the respondent Nos.4 to 7 and the police never wanted to involve.

6.By recording the submissions made by the learned Government Advocate (Crl.side), this Petition is closed directing both the parties to approach the civil Court in respect of the civil dispute.
