Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the respondents 1 to 4 not to disburse the entire amount deposited by the petitioner's father late V.Rajendran before the respondents 3 and 4 bank till the shares of the petitioner and the respondents 5 to 7 were resolved by the civil court.

ORDER

The petitioner is the son of Late V.Rajendran who died on 07.05.2025. The petitioner and the 6th respondent are the children born to the first wife namely 2/6

Manimegalai who died on 10.09.1981. Thereafter the petitioner's father contracted the second marriage with the fifth respondent. The seventh respondent is the daughter born through the second wife namely, fifth respondent. Thus, the seventh respondent is the half sister of the petitioner and the sixth respondent which is admitted by the petitioner that the petitioner's Late father had nominated the fifth respondent as a beneficiary while opening the bank account with the third and fourth respondent bank.

2. Since the petitioner has given a representation dated 19.06.2025 to the banks not to disburse the amount, I am inclined to dispose this writ petition at the time of admission by dispensing notice on the private respondents by directing the respondents 1 to 4 to consider the representation dated 19.06.2025 issued on behalf of the petitioner from liquidating the fixed deposits which stood in the name of the petitioner's deceased father Mr.V.Rajendran. The representation shall be considered and disposed by the respondents after hearing the private respondents who are the other legal heirs of the deceased father of the petitioner Late Mr.V.Rajendran. This exercise shall be completed within a period of one month from the date of receipt of a copy of this order after due notice to the 3/6

concerned parties. Pending such exercises the amount shall not be disbursed.
