After filing the petition to restrain respondents 1 to 3 from conducting a survey of lands described in the petition, learned counsel for the petitioner submits that the matter has become infructuous in view of the revenue officials declining to proceed with such survey on account of the pending civil suit.

2. By recording such statement, this writ petition is dismissed as infructuous without any order as to costs.
