This Civil Miscellaneous Petition has been filed to condone the delay of 703 days in representing the above C.M.A.(MD).SR.No.49236 of 2023. 1/3

2.The insurance company has filed the present civil miscellaneous appeal against the award passed in M.C.O.P.No.552 of 2020 on the file of the Motor Accidents Claims Tribunal/ Special District Judge, Thanjavur. 3.The learned counsel appearing for the insurance company would submit that they have challenged the liability alone. The third respondent is the contesting respondent who has been served with notice.

4.Mr.Ganapathi Raman, learned counsel undertakes to file vakalat, on behalf of the third respondent.

5. This Court perused the affidavit filed in support of this petition and being satisfied with the reasons stated in the affidavit, this petition is allowed on condition to deposit the entire decree amount within a period of two weeks from the date of receipt of copy of this order.
