ORDER
The petitioner herein seeks a direction to the respondents to issue joint patta in the name of the petitioner and two others, in the light of the judgment passed by the civil court in O.S.No.178/2012 on the file of District Munsif Court, Sivagangai, in respect of the property situated in Survey No.288/12, Keezhpoongudi Village, Sivagangai Taluk, Sivagangai District, by considering his representation, dated 19.01.2023.
2. It is the case of the petitioner that his mother Kalyani submitted a representation before the respondents, seeking issuance of patta in respect of the subject property, based on her long possession. She died on 29.06.2010. Thereafter, the petitioner and his sisters, namely, Meenachi and Alamelu filed a suit in O.S.No.178 of 2012 on the file of District Munsif Court, Sivagangai, against the Government of Tamil Nadu, represented by the first respondent and the fourth respondent, seeking declaration of title and
injunction in respect of the subject property. The said suit was decreed as prayed for. Now, on the strength of the civil court's decree, the petitioner submitted a representation before the respondents on 19.01.2023, seeking issuance of patta. The same has not been considered. Hence, he has come before this Court.
3. Additional Government Pleader, who takes notice for the respondents, submits that the request of the petitioner will be considered in accordance with law.
4. Since there is a civil court decree in favour of the petitioners, declaring their title, the respondents may not have any impediment to consider the request of the petitioner for issuance of patta in his name and in the names of his two sisters, namely, Meenachi and Alamelu.
5. Under these circumstances, the fourth respondent is directed to consider the representation of the petitioner, dated 19.01.2023, positively and pass orders on its own merits within a period of six weeks from the date of receipt of copy of this order.
6. Accordingly, the Writ Petition is disposed of. No costs. 26.06.2025
