For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.145 of 2023 on the file of the respondent police ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 294(b), 323, 324 and 506(2) of IPC, in Crime No.145 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant is working as a Real Estate Broker. On 23.06.203 at about 07.30 p.m., the defacto complainant and one Kalimuthu and Prabhu went to see the land, which is belonging to the defacto 1/3

complainant's uncle Muniraj. At that time, the accused persons came there and asked the defacto complainant that how they can come see the place in their area and abused in filthy language and also attacked him with sticks and stones. Hence, the complaint.

4. The learned counsel for the petitioner submits that the petitioner is an innocent persons and he has not committed any offence as alleged by the prosecution. He further submitted that this petition has been filed mainly on the ground that accused No.1 to 4 were arrested and thereafter, released on bail.

5. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that four previous cases are pending against this petitioner and he is the habitual offender.

6. Taking into consideration of the allegations and also the bad antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
