ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 20(b)(ii)A, 29(1), 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 77 of the Juvenile Justice (Care and Protection of Children)Act, 2015 in Crime No.57 of 2023 on the file of the 1/3
respondent police, seeks anticipatory bail.
2.The case of the prosecution is that based on the secret information, the Sub Inspector of Police, attached to the respondent police, visited the occurrence place, namely, nearby Kamarajar Auto Stand. On seeing police party, A1 & A2 attempted to escape from the place. The police intercepted them and recovered 365 kgs of ganja from them and they confessed that they used to buy ganja from the petitioner herein and sell the same to the school and college students. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that the petitioner is a college going student and prayed for anticipatory bail. 4.The learned Additional Public Prosecutor appearing for the respondent police submitted that the petitioner is arrayed as A3 in this case. The petitioner was studying in Scott Christian College, Nagercoil. However, he did not write first semester and did not attend college from second semester. He also produced the letter from the college.
5.This Court directed the learned counsel appearing for the petitioner to produce the Identity Card of the petitioner. Instead of producing Identity Card, he produced receipt of payment of fees. It is also seen that the petitioner did not attend the college regularly. The offence committed by the petitioner is serious in nature. 2/3
Hence, the petitioner is not entitled for anticipatory bail. Accordingly, this criminal original petition is dismissed.
