The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 392 of I.P.C, in Crime No.213 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 27.05.2023, when the defacto complainant going to her house, two persons came to the spot in two wheeler and snatched the defacto complainant's gold thali chain weighing about 8 soverigns. Hence, the complaint.
3.The learned Government Advocate (Crl. Side) would submit that the petitioner is a habitual offender involving more than one case under Section 392 of IPC.
4.The learned counsel for the petitioner would submit that even as per the FIR no allegation has been made against the petitioner. The allegation is the the chain of the defacto complainant was snatched. Only during the course of investigation it came to the light.
5.The learned Additional Public Prosecutor would submit that recovery has also been made and returned to the defacto complainant. Since the petitioner is habitual offender, he is not entitled any discretionary relief from this Court. This petition deserves to be dismissed.
