RESPONDENTS Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to issue Writ of Ceriorarified Mandamus to call for records pertaining to the impugned order in Na.Ka.No. 155/2019 dated 31.07.2019 on the file of the respondent No.2 and quash the same as illegal and consequently directing the respondents to permit the petitioner and others devotees to worship their goddess namely Arulmigu Pemalaiyamman at Rakkatchi Amman Temple during full moon day of tamil Month of Aadi i.e., on 14.08.2019 within the time stipulated by this Hon`ble Court.
ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.T.THIRUMURUGAN, Advocate for the petitioner and of Mr.A.K.BASKARAPANDIAN, Special Government Pleader on behalf of the Respondents, the court made the following order:- [Order of the Court was made by M.SATHYANARAYANAN,J.] The matter in issue pertains to the alleged right of the petitioner and other devotees to worship their family Goddess every year during the Full Moon Day of the Tamil month 'Aadi' and it is https://hcservices.ecourts.gov.in/hcservices/ 1/2
WP(MD) No.17626 of 2019 the case of the petitioner that all along, such a permission has been granted and for this year, such a permission is refused.
2. Mr.A.K.Baskarapandian, learned Special Government Pleader accepts notice on behalf of the respondents and seeks time to get instructions.
3. Call on 13.08.2019 immediately after admission.
4. Meanwhile, the learned Counsel for the petitioner is directed to file an affidavit as to how many persons are going to worship in the said temple along with the details of Aadhaar Numbers, etc., The learned Special Government Pleader appearing for the respondents should also find out as to whether in the event of permission being granted, any Forest Department Official can accompany them and if so, the expenses to be incurred in that regard.
