O R D E R
This Writ of Mandamus has been filed, seeking a direction to the respondents 1 to 3 to take appropriate departmental action against the fourth respondent by considering the petitioner's representation dated 11.11.2016.
2.Heard the learned counsel for the petitioner and the learned Special Government Pleader for the first respondent and the learned Government Advocate for the respondents 2 and 3. By consent, the writ petition itself is taken up for final disposal at the stage of admission.
https://hcservices.ecourts.gov.in/hcservices/ 3.The fourth respondent is working as a Village Assistant in the third respondent panchayat, in which, Ulagamman Koil Oorani
is situated. The fourth respondent by using motor, pumped out the water from the said tank and when the same was questioned by the petitioner along with one Murugesan, the fourth respondent abused them and attacked the family members of the petitioner and in respect of which, a case in Crime No.400 of 2016 has been registered under Sections 294(b), 323, 427 and 506(i) of the Indian Penal Code. But the respondents 1 and 2 have not taken any further action against the fourth respondent. Therefore, the petitioner has submitted a representation dated 11.11.2016, requesting the respondents 1 & 2 to take action against the fourth respondent. As the same is not considered, this writ petition has been filed.
4.The fourth respondent is not served with notice as there is direction to give the same at the time of consideration of representation. However, having regard to the limited scope of the prayer sought for in this case, the writ petition disposed of with a direction to the respondents 1 to 3 to dispose of the representation dated 11.11.2016 within a period of six weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner as well as to the fourth respondent. No costs.
