Karthick (Life Convict Prisoner No.6328, PID No.18796) S/o. Ponmuthu aged about 43 years, who is now confining at Central Prison, Madurai, from the prison on the ordinary leave for 28 days without escort by considering the petitioner's representation dated 05.05.2026 in accordance with law.

O R D E R
[Order of the Court was made by N.ANAND VENKATESH, J.] This Writ Petition has been filed challenging the impugned proceedings of the first respondent made in No.521/OO.Tha.2/2026, dated 21.05.2026 and for a consequential direction to the first respondent to grant 28 days ordinary leave to the convict, who is presently serving sentence at Central Prison, Madurai.
2. Heard the learned counsel for the petitioner and the learned Counsel for State of TN (Crl.Side) appearing on behalf of the respondents.
3. The petitioner is a life convict, who is presently undergoing
sentence at Central Prison, Madurai. The petitioner submitted a representation seeking ordinary leave on the ground that his wife is suffering from some medical ailments and she requires the physical and emotional support of the petitioner.
4. The representation made by the petitioner came to be rejected by the first respondent, mainly on the ground that there is one pending case against the petitioner. Aggrieved by the same, the present Writ Petition has been filed before this Court.
5. The learned Counsel for State of TN (Crl.Side) submitted that the convict has undergone a sentence of 10 years and 3 months and on 7 earlier occasions, he was granted emergency leave.

Taking into consideration the facts and circumstances of the case and considering the reason, for which the ordinary leave has been sought for and taking note of the fact that earlier emergency leave had been granted on seven occasions and nothing untoward took place, this Court is inclined to interfere with the impugned proceedings of the first respondent,
dated 21.05.2026 and the same is hereby set aside. There shall be a direction to the first respondent to grant 28 days ordinary leave to the petitioner subject to the condition that the petitioner shall report before the 4th respondent Police daily at 5.00 PM during the entire ordinary leave period and surety shall be executed before the jail authorities.
7. This Writ Petition (Criminal) is allowed with the above directions. No costs.
