PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.396 of 2024 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 365, 294(b), 323, 324, 506(2) of IPC, in Cr.No.396 of 2024, seeks anticipatory bail.

2.The case of the prosecution is that the defacto complainant borrowed a sum of Rs.10,00,000/- for interest from the petitioner towards his business development. Thereafter, there was default in paying the interest. Even repeated demands were made by the petitioner, the defacto complainant failed to repay the principal as well as the interest. Thereby, the petitioner and the other accused have abused the defacto complainant in filthy language and attacked him with iron rod and caused injuries. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that this is the second anticipatory bail petition. Earlier petition filed by the petitioner in Crl.OP(MD)No.10094 of 2024 was dismissed by this Court on 11.07.2024. However, the injured was discharged from the hospital. Hence, he prays for grant of anticipatory bail to the petitioners. 4.The learned Additional Public Prosecutor and the learned counsel for the defacto complainant would submit that the investigation is in preliminary stage and 2/4

the petitioner is having 13 previous cases. Further, considering the previous antecedents of the petitioner, earlier anticipatory bail petition filed by him was dismissed by this Court on 11.07.2024. Hence, they vehemently, opposed to grant anticipatory bail to the petitioner.

5. Considering the nature of allegations and also considering the fact that there is no change of circumstances to entertain the present anticipatory bail application, this Court is not inclined to enlarge the petitioner on anticipatory bail. 6.Accordingly, this Criminal Original Petition stands dismissed. sd/- 06/08/2024 / TRUE COPY / /08/2024 Sub-Assistant Registrar (C.S.I /II /III /IV ) Madurai Bench of Madras High Court, Madurai - 625 023.
