ORDER
The petitioner, a Transport Corporation employee, has approached this Court that he is entitled for salary review once in six years and he has not been provided with any salary review and has filed this writ petition seeking a writ of mandamus directing the respondent/ Transport Corporation to provide first and second salary reviews to the petitioner.
2.The respondents have filed a counter affidavit that the petitioner was awarded nearly 36 punishments from 12.10.2009 to 17.11.2020 for his misconduct in fare collection, negligence in duty, mis-behaviour towards his officers & public and unauthorized absence. For his wilful 2/5
disobedience in duty, punishment was imposed, after a thorough enquiry. In view of 36 punishment during his duty, the petitioner was not provided with any salary review.
3.The learned counsel for the petitioner has denied that the petitioner was imposed with 36 punishments.
4.This Court has considered the submissions made on either side and perused the available materials on record. 5.The petitioner has been appointed as a reserve conductor, on 06.09.2007 and he was treated as daily wage from 02.08.2008 and thereafter, he was regularized as a permanent employee on 30.07.2009. The petitioner is entitled to get the first salary review on 06.09.2013 and he is also entitled for the second review on 06.09.2020. The respondents have taken a plea that the petitioner has committed several irregularities, for which, disciplinary proceedings have been initiated and he was awarded nearly 36 punishments from 12.10.2009 to 17.11.2020. details of the punishment has also been produced before this Court. In view of the same, this Court is not inclined to grant any relief to the petitioner. Accordingly, this writ petition is dismissed.
