For Respondent : Mr.R.Erottuchamy, Government Advocate (Criminal Side) PETITION FOR MODIFICATION Under Section 439 (1)(B)of Cr.P.C. PRAYER :- To modify the condition No.1, imposed in Cr.MP.No.2544 of 2020 dt.24.7.2020 passed by the Learned Principal Sessions Judge,Tiruchirappalli so far as the imposition of condition to deposit a sum of Rs.60,000/- in the case Crime number. ORDER : The Court made the following order :- This petition has been filed to modify the condition no.1 imposed by the learned Principal Sessions Judge, Tiruchirapalli in Cr.M.P.No.2544 of 2020 dated 24.07.2020.

2. The learned counsel for the petitioner would submit that the learned Principal Sessions Judge, Tiruchirapalli by an order dated 24.07.2020 granted anticipatory bail to the petitioner directing the petitioner to pay a sum of Rs.60,000/- in the case crime number. He would further submit that the petitioner is a poor agriculturist and he is unable to mobilize the fund within the time imposed by the Court. Hence he moved a modification petition in Cr.M.P.No. 3248 of 2020 before the learned Principal Sessions Judge, Tiruchirapalli and the learned Judge has extended the time till 20.11.2020, however the https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.14751 of 2020 petitioner is unable to mobilize fund because of his poverty. Hence he seeks modification of the said condition.

3.This Court finds no merits in the petition and the order dated 24.07.2020 passed by the learned Principal Sessions Judge, Tiruchirapalli in Cr.M.P.No.2544 of 2020 does not require any modification.

4.Hence the petition stands dismissed. However two week time is extended to comply with the conditions imposed by the learned Principal Sessions Judge, Tiruchirapalli in Cr.M.P.No.2544 of 2020. All other conditions shall remain unaltered.
