PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order in e/f/vz;/ 83 /bghJ g{te;jp fh/ep/2023 dated 30.06.2023 and quash the same as illegal and consequently direct the second and third respondents to grant necessary permission and provide adequate police protection for conducting the Adal Padal program on 06.07.2023 at about 07.00 p.m., to 10.30 p.m., as part of temple festival of Arulmighu Shri Badrakaliamman Temple function at Vilathur Village, Manamadurai Taluk, Sivagangai District, by considering the petitioner's representation dated 21.06.2023.

This petition is filed seeking for a direction to the police to permit the petitioner to conduct Aadal padal program on 06.07.2023 at Arulmighu Shri Badrakaliamman Temple function at Vilathur Village, Manamadurai Taluk,

It is submitted by the learned counsel for the petitioner that the request made by the petitioner on 21.06.2023 to permit them to conduct Aadal Padal was declined by the impugned order, dated 30.06.2023. Learned Government Advocate (Criminal side) submitted that last year when permission was granted, both the groups have fought among themselves, thereby, the police had to file a case before the Executive Magistrate and when the matter is pending before the Revenue Divisional Officer, both the groups stated to have settled and compromised the matter. The police have stated to have declined permission that similar incident may have likely to happen this year also. 2/4

3. Since it is submitted by the learned counsel for the petitioner that they will give an undertaking to the police that they will not resort to any such things which resulted in filing of a criminal case last year, requested the Court to give suitable instruction.

4. This writ petition therefore is disposed of, with a direction to the petitioner to file a fresh application before the police and on filing of such application, the concerned police is directed to review the same afresh and dispose of the same, keeping in view of the fact that the festival is scheduled to be celebrated today. The concerned police is directed to expedite the disposal of the said petition. No costs.
