ORDER

This petition has been filed to call for the records relating to the order passed by the learned Principal District and Sessions Judge, Pudukkottai in Crl.M.P.No.884 of 2022 dated 04.03.2022 and to set aside the same. 1/4

2.The grievance of the petitioner is that he was directed to remit a sum of Rs.40,000/- as non refundable amount to the account of Hospital Maintenance Fund-Government Medical College Hospital, Pudukkottai. He is not in a position to comply with the aforesaid condition as the amount has been excessive in nature.

3.Considering the fact that the petitioner is not having any previous bad antecedent on the earlier occasion and also considering the quantity of the sand that was illegally transported, the amount is reduced from Rs.40,000/- to Rs. 20,000/-.

4.Accordingly, condition No.i) that has been imposed upon the petitioner by the trial Court vide order dated 04.03.2022 is modified as follows:- i) The petitioner is directed to remit a sum of Rs.20,000/- as non refundable amount to the aforesaid account as stated by the trial Court. 5.The other conditions that has been imposed upon the petitioner by the trial Court shall remain unaltered.
