ORDER

The present petition has been filed by the Accused Nos.1 to 3 in crime No.136 of 2026, on the file of the second respondent police seeking a direction as against the trial Court to consider the bail application of the petitioners on the same day of surrender.

2. Today, the matter is listed under the caption for maintainability.

3. The Registry has raised an objection regarding the maintainability of the present petition on the ground that the FIR has not been enclosed. Today, a copy of the FIR has been placed before this Court by the learned Government Advocate (Criminal Side) appearing for the Respondent Nos.1 & 2. Therefore, the objection raised by the Registry stands negatived. 2/4

4. Considering the above said facts, there shall be a direction to the learend Judge, Special Court for trial of cases under SC and ST, Prevention of Atrocities Act, Nagercoil, Kanyakumari District, to consider the bail application of the petitioners on the same day of surrender in Crime No.136 of 2026, after giving due opportunity to the defacto complainant.

5. The petitioners shall surrender before the concerned Court on or before 02.07.2026.

6. With the above said observations, this Criminal Original Petition stands allowed.
