PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the impugned Refusal Check Slip in RFL/Gangaikondan/101/2025, dated 29.05.2025, issued by the Sub Registrar, Gangaikondan, Tirunelveli District, the 3rd respondent herein, refusing to register the settlement deed, dated 29.05.2025 and to quash the same and consequently, to direct the respondents to register the settlement deed, dated 29.05.2025, presented by the petitioner in favour of his brother and to return the documents on its registration forthwith. ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus to quash the impugned refusal check slip in RFL/Gangaikondan/101/2025, dated 29.05.2025, issued by the 3rd respondent and consequently, to direct the respondents to register the settlement deed, dated 29.05.2025, presented by the petitioner in favour of his brother and to return the documents on its registration forthwith.
2.Through the impugned order, the respondents have stated that the survey numbers stated in the present settlement deed includes PACL properties. 3.The Learned Counsel appearing for the petitioner submitted that the petitioner has purchased several properties in which some of the properties are stated as PACL properties. However, the petitioner has purchased the other properties which are not belonging to PACL. Thus, the respondents ought to register the settlement deed with respect to the properties which are not covered under the said list of PACL properties. Therefore, the impugned order cannot be sustained.
4.On perusal of the impugned order, it is seen that the petitioner is settling the Survey Nos.371/1, 372/1, 456, 457 and 534/1 in the present settlement 2/4
deed. The above stated survey numbers are not in the list of properties which is shown as properties belonging to PACL. Therefore, the impugned order is total non application of mind and the same is quashed. The respondents are directed to register the document within a period of four weeks from the date of receipt of a copy of this order.
5.With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
