ORDER

(Order of the Court was made by N. ANAND VENKATESH,J.) This Habeas Corpus Petition has been filed for a direction to the respondents to produce the body or person of the detenue, who is the niece of the petitioner and to set her at liberty.

2. Heard the learned counsel on either side.

3. The case of the petitioner is that the petitioner was taking care of the detenue from the young age and that on 02.05.2026, the detenue left the residence to the college and thereafter, the whereabouts of the detenue was not able to be ascertained. In view of the same, a complaint was given before the second respondent, based on which, a woman missing FIR has been registered in Crime No.127 of 2026. Since no effective steps were taken to ascertain the whereabouts of the detenue, the present Habeas Corpus Petition has been filed.

The learned counsel for the State of Tamil Nadu (Criminal Side) on instructions submitted that the girl had developed a relationship with a boy and as per the latest information, the girl and the boy are at Himachal Pradesh. The learned counsel further submitted that steps are being taken to secure the girl and proceed further in accordance with law.

5. Taking into consideration the facts and circumstances of the case and considering the nature of the grievance expressed by the petitioner and taking note of the latest information, there shall be a direction to the second respondent to secure the detenue and produce her before the learned Judicial Magistrate, Lalgudi. The learned Judicial Magistrate shall record the statement of the detenue and proceed further in accordance with law.
