PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to issue a direction directing the respondent no.1 to withdraw the case in Crime No.225 of 2023 from the respondent no.3 and transfer the case in Crime No.225 of 2023 on the file of the respondent no.3 to respondent no.2.

ORDER

This petition has been filed seeking transfer of investigation in Crime No.225 of 2023 from the respondent no.3 to the respondent no.2. 2.The grievance of the petitioner is that even the case has been registered for the offences punishable under Sections 294(b), 324, 427, 506(ii) of IPC in Crime No.225 of 2023 on 19.06.2023, no proper investigation has been undertaken by arresting the accused. 3.The learned Government Advocate (Crl. Side) would submit that the accused was arrested and released on bail. Now the Investigation is almost over. They awaiting for wound certificate. 4.In view of the submissions made by the learned Government Advocate (Crl. Side), there is no transfer of investigation at this stage. Let the investigation be completed by the respondent police within a period of two months from the date of receipt of a copy of this order. 2/4

5.With the above said directions, this petition stands disposed of. 21.11.2023 NCC :
