Prayer :- Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondents 1 and 2 to survey and measure the petitioner property comprised in Survey No.447/12 extent of 0.0053.0 hectares situated at Nathampatti Village, Watrap Taluk, Virudhunagar District, on the basis of consider the petitioner representation dated 17.06.2025 within the time stipulated by this Court.

ORDER

The petitioner herein seeks a direction to the respondents 1 and 2 to survey and measure her property comprised in Survey No.447/12, with an extent of 0.0053.0 hectares situated in Nathampatti Village, Watrap Taluk, Virudhunagar District, by considering her representation dated 17.06.2025.

2.Heard the arguments of Mr.T.Dineshpandi, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents 1 and 2 and Mr.M.Vaikkam Karunanithi, learned Government Advocate appearing for the respondents 3 and 4. Since no adverse order is passed against the fifth respondent, notice to the fifth respondent is dispensed with. 3.By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

4.According to the petitioner, she purchased the subject property from one Kalishwaran @ Kali under a sale deed dated 21.03.2024. Subsequently, the petitioner submitted an application seeking survey of the property on 08.05.2025. The same has not been considered. Hence, the petitioner submitted a written representation before the first respondent on 17.06.2025. Inspite of the same, the request of the petitioner for survey has not been considered. Hence, the petitioner has come before this Court.

5.The learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that the subject property was already surveyed by the second respondent on 16.02.2024. Therefore, the petitioner's subsequent request for survey of the property has not been considered.

6.It is seen from the records that in response to the application for survey submitted by the petitioner dated 16.12.2024, the subject property was surveyed on 30.12.2024. Not satisfied with the same, the petitioner again submitted an application seeking survey of the property. However, the petitioner has not produced acknowledgment for submitting the online application. In these circumstances, the petitioner is directed to produce the acknowledgment for having submitted an online application before the first respondent within a period of two weeks from the date of receipt of a copy of this order. On such production of acknowledgment, the respondents 1 and 2 shall consider the online application of the petitioner seeking survey of the subject property, after issuing notice to the petitioner, fifth respondent herein and other interested parties, within a period of twelve weeks from the date of receipt of the
