J U D G M E N T

The appeal suit has been filed against the judgment and decree passed by the District Court in O.S.No.7 of 2014, dated 27.08.2018.

2. When the matter is taken up for hearing today, the appellant is present before this Court and made a statement that she has received the advance amount by way of cheque and the matter has been settled out of Court and hence, she prayed that the appeal may be disposed of as settled out of Court. To that effect, she has also filed a Joint Compromise Memo, dated 05.06.2023, duly signed by the appellant as well as her counsel.

3. In view of the above, the Appeal Suit is dismissed as settled out of Court, in terms of the Joint Compromise Memo, dated 05.06.2023. The joint compromise memo, dated 05.06.2023, shall form part of the decree and judgment. No costs. Consequently, the connected Miscellaneous Petition is closed. 2/12

4. Since the matter is settled out of Court, the Registry is directed to refund the Court fee.
