For Respondent : Mr.V.Neelakandan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory bail in Crime No.200 of 2019 on the file of the Respondent Police ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 294 (b), 323, 324, 307, 506 (ii) and 427 of IPC, in Crime No.200 of 2019, seeks anticipatory bail.

2.The learned counsel appearing for the petitioner has submitted that the petitioner is an innocent person and he has been falsely implicated in the above case. He further submitted that already co-accused in this case was granted bail by this Court in Crl.OP(MD)No.7856 of 2019. Hence, he prayed for grant of anticipatory bail to the petitioner.

CRL OP(MD). No.11547 of 2019 respondent has submitted that due to some wordy quarrel, the petitioner along with other accused persons attacked the victim with deadly weapons. He further submitted that two previous cases are pending against the petitioner under Section 307 of IPC and 188 of IPC. He further submitted that the investigation is still pending and the custodial interrogation is absolutely necessary. Hence, he opposed to grant anticipatory bail to the petitioner. 4.This is the third application seeking anticipatory bail. The first application seeking anticipatory bail in Crl.OP(MD)No.8810 of 2019 was dismissed by this Court on 27.06.2019. The second application seeking anticipatory bail in Crl.OP(MD)No.10169 of 2019 was dismissed by this Court on 19.07.2019.

5.Taking into consideration of the submission made by the learned Additional Public Prosecutor that two previous cases are pending against the petitioner and also the fact that the custodial interrogation of the petitioner is absolutely necessary and also the fact that the petitioner has not pointed out any change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this petition is dismissed.
