Respondent Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to the order, dated 20.03.2019 in PW.21/2018, on the file of the first respondent herein, and to quash the same, and direct the second respondent to pay the petitioner all his wages for the period from 02.08.2002 to 30.06.2017, together with the earned leave accumulated for eight months at the rate of Rs.20,080/- per month, together with interest for all the payments at the rate of 18% per annum, from the date when they became due and payable to the petitioner till payment, within a time frame as may be fixed by this Court. ORDER

The present writ petition has been filed by the workman challenging the order passed by the first respondent herein under the Payment of Wages Act, wherein, it is held that his application under the Payment of Wages Act is not maintainable and he has to approach the authorities under the Industrial Disputes Act.

2. On instructions, the learned Counsel appearing for the writ petitioner seeks permission of this Court to approach the authorities under the Industrial Disputes Act.

3. Considering the fact that the writ petition is pending from 08.08.2019 onwards, the period spent between 08.08.2019 and the date of receipt of copy of this order shall be excluded for calculating the period of limitation. 2/4

4. With the above said liberty, this writ petition stands closed. There shall be no order as to costs. Consequently, connected Miscellaneous Petition stands closed.
